Who are THE MISSING? Remebering To, Not Forget

  332.1.1 DEFINITIONS (PENAL CODE 14213)

----this is from the California Penal Code, but all of LE in the US follow the same standards. it has been standardized to reach across jurisdiction with the same language, data, DNA, and reports etc. 

Missing Person Any person whose whereabouts are unknown to the reporting party including, but not limited to, a child taken, detained, concealed, enticed away or retained by a parent in violation of Penal Code § 277. Missing person also includes any child who is missing voluntarily, involuntarily or under circumstances not conforming to his/her ordinary habits or behavior and who may be in need of assistance.

Child-

While California considers a child to be a person under eighteen years of age, for purposes of this section federal law considers any person under the age of twenty one years to be a child.

CLETS Missing Person System Report Types --- It is up to the officer taking the report to determine which type and category the report falls into.

(a) Voluntary Missing Adult Missing adult who has left of his/her own free will.


(b) Stranger Abduction Missing person taken by a stranger. Includes cases of a known abductor who is not a family member. If under 18, this information will be forwarded to the FBI’s Child Abduction and Serial Killer Unit (CASKU) and the National Center for Missing and Exploited Children (NCMEC).


(c) Parent/Family Abduction Missing juvenile taken by parent or nonparent family member.


(d) Runaway Missing juvenile is reported as a runaway or is not wanted by his/her parents.


(e) Suspicious Circumstances Person missing under circumstances that may indicate foul play. If under 18, this information will be forwarded to the FBI’s CASKU and the NCMEC.


(f) Catastrophe Missing person is a victim of a disaster (e.g., boating accident, plane crash, earthquake, flood, fire).


(g) Lost Missing person who has strayed away and whose whereabouts are unknown. circumstances surrounding missing person’s disappearance are unknown.


(i) Dependent Adult Missing adult (over age 18) who has physical or mental limitations, which restrict his/her ability to carry out normal activities.

Officers may use discretion when determining the presence of risk based on experience, expertise and the specific facts and circumstances of each case.

332.2 REPORT ACCEPTANCE
All personnel shall accept any report, including any telephone report, of a missing person, including runaways, without delay and shall give priority to the handling of these reports over the handling of reports relating to crimes involving property. Reports shall be taken on missing persons regardless of jurisdiction. Penal Code § 14205 (a)

(d) If the missing person is under 21 years of age, or there is evidence that the person is at risk, the police department or sheriff's department shall broadcast a “Be On the Lookout” bulletin, without delay, within its jurisdiction.

(e)If the person reported missing is under 21 years of age, or if there is evidence that the person is at risk, the law enforcement agency receiving the report shall, 

within two hours after the receipt of the report, electronically transmit the report to the Department of Justice via the California Law Enforcement Telecommunications System for inclusion in the Violent Crime Information Center and the National Crime Information Center databases.

(f) Information not immediately available for electronic transmission to the department shall be obtained by the investigating agency and provided as a supplement to the original entry as soon as possible, but in no event later than 60 days after the original electronic entry.  Supplemental information may include, but is not limited to, the following:

(1) Dental records and treatment notes.

(2) Fingerprints.

(3) Photographs.

(4) Description of physical characteristics.

(5) Description of clothing the person was wearing when last seen.

(6) Vehicle information.

(7) Other information describing any person or vehicle believed to be involved in taking, abducting, or retaining the missing person.



 Department of the California Highway Patrol taking the report shall, without delay, and, in the case of persons under 21 years of age or where there was evidence that the missing person was at risk, within no more than 24 hours, notify, and forward a copy of the report to the police or sheriff's department or departments having jurisdiction of the residence address of the missing person or runaway and of the place where the person was last seen.  The report shall also be submitted by the department or division of the Department of the California Highway Patrol which took the report to the center.  The initial California Law Enforcement Telecommunications System record may only be removed after the receiving agency has accepted the report.

Missing Persons

(a) As used in this title, "missing person" includes, but is not limited to, any of the following:

(1) An at-risk adult.

(2) A child who has been taken, detained, concealed, enticed away, or retained by a parent in violation of Chapter 4 (commencing with Section 277) of Title 9 of Part 1.

(3) A child who is missing voluntarily or involuntarily, or under circumstances not conforming to his or her ordinary habits or behavior and who may be in need of assistance.

(b) As used in this title, "at risk" means there is evidence of, or there are indications of, any of the following:

(1) The person missing is the victim of a crime or foul play.

(2) The person missing is in need of medical attention.

(3) The person missing has no pattern of running away or disappearing.

(4) The person missing may be the victim of parental abduction.

(5) The person missing is mentally impaired.

(c) As used in this title, "child" is any person under 18 years of age.

(d) As used in this title, "center" means the Violent Crime Information Center.

(e) As used in this title, "dental or medical records or X-rays" include all those records or X-rays which are in the possession of a dentist, physician and surgeon, or medical facility.

(f) As used in this title, "unidentified person" means a person, living or deceased, whose identity the local investigative agency is unable to determine.

      Xavior Harrelson, an 11-year-old boy who has been

      The Iowa Medical Examiner's Office has 

      confirmed

       that a body found in a rural field Sept. 

      30 is that of

       Xavior Harrelson, an 11-year-old

       Montezuma boy 

      missing since May 27.
      The Poweshiek County Sheriff's Office

       announced 

      the finding in a posting on its Facebook page 

      Friday night. It said it was not immediately 

      releasing the cause of his death.
      Mitch Mortvedt, assistant director of the Iowa 

      Department of Criminal Investigation, said 

      Xavior's death was being investigated as s

      uspicious.
      Law enforcement officials are asking anyone

       with 

      information about Xavior's disappearance and

       death to contact the Poweshiek County Sheriff's

       Office at 641-623-5679 or the Missing Person

       Clearinghouse at 800-346-5507. Digital

       information, such as videos or pictures, 

      may be submitted at fbi.gov/findxavior.
      A farmer tending to his soybean crop near 

      110th Street and Ewart Road, about 4 miles

       from Xavior's home, found the body in a

       nearby field.

      Xavior had been reported missing just days 

      from his 11th birthday. He was last seen near 

      his home in the northwest part of Montezuma
      "We will never forget Xavior and his kind heart," 

      Jacki Bolen, the Mayor of Montezuma, told the 

      Des Moines Register after the confirmation of 

      Xavior's death. "The Montezuma community is

       greatly saddened by the news of Xavior's passing.

       We express our deepest sympathy to his family 

      and friends."
      Xavior was known for his joyful, childish smile 

      and shining dimples, his kindness, and the ability

       to make others laugh. His mother, 

      Sarah Harrelson, had described him as a helper.

      In the four months since he vanished,

       the community

       has raised more than $35,000 in reward money 

      through vigils, fundraisers and a benefit concert,

       hoping to entice anyone with information to 

      come forward.

      Speaking in August, Sarah Harrelson said the wait 

      for news 

      of her son was excruciating.
      "The word 'why' will drive you crazy. Why him?"

       Harrelson said.
      Speaking Oct. 1, the day after the discovery of the 

      body, 

      Bolen said the community was left in shock, fear, 

      and sadness.
      "Fear that it's Xavior. Fear that it's foul play," 

      Bolen told the Register. "We want our kids to 

      be safe. 

      This should never happen to anyone."

      The confirmation of Xavior's death comes three 

      years after

       the discovery of the body of another Poweshiek 

      County resident, Mollie Tibbets, off a dirt road, 

      surrounded by cornfields. Tibbetts, a 20-year-old 

      college student was reported missing after a run

       near her hometown of Brooklyn, 

      15 miles from Montezuma.


      The morning after adolescent human remains

       were 

      found in rural Montezuma,

       a Xavior Harrelson missing sign was still

       hanging

       in the window of The Daily Grind, just 

      off the city's

       main street. On Friday, the Poweshiek 

      County 

      Sheriff's Office said the body had been 

      identified 

      as Xavior's.



      Cristhian Bahena Rivera, a farmhand, 

      was later 

      convicted of murder in her death.

      LA VISTA, Neb. (WOWT) — La Vista Police

      reported no new developments Thursday in the

      search for Ryan Larsen, the 11-year-old boy

      with autism who has been missing for 11 days,

      but reiterated that multiple agencies were

      continuing to review and analyze surveillance

      video.




      “Due to the time that has passed without any sign of 

      Ryan, investigators are exploring all possible scenarios, 

      as we do with all missing-

      persons cases,” LVPD said in an afternoon news

      release. “While we are grateful for the

      countless tips and sighting reports we have

      received from the community,

      no other sightings have been confirmed to

      have been Ryan Larsen.”




      Authorities consider Ryan an Endangered

      Missing Person. LVPD said they are continuing

      to work with the FBI —

      in Omaha and Quantico, Va. —

      Nebraska State Patrol, as well as other local,

      state, and federal agencies.

      According to the release,

      LVPD will continue to partner with those

      agencies “until Ryan is found and his case

      is closed.”




      The search officially moved away from Walnut

      Creek Recreational Area on Wednesday,

      but authorities noted they would return to the

      area should any further information lead

      back there.




      LVPD asked for the family’s privacy to be

      respected.




      “We are updating them frequently on our search for Ryan,

       and they are understandably fearful and concerned.

      Please be understanding of their decision regarding

       public comments or lack thereof,”

      the release states.

      at noon. A neighbor at the apartment complex

      where his family lives later reports seeing

      Tuesday May 18: LVPD responds to two

      possible sightings of Ryan, including one near

      the La Vista Library.




      Wednesday May 19: LVPD asks for federal

      assistance in the search for Ryan.

      The FBI and FEMA become involved in

      the case.




      Thursday May 20: LVPD a caution tape

      perimeter around Walnut Creek Lake in

      Papillion to discourage groups from gathering

      there as authorities focus their search for

      Ryan there. In a news conference that night,

      Police Chief Bob Lausten urges the public

      not to speculate or share rumors, saying it does

      more harm than good.




      Friday May 21: La Vista Police reveal that K9

      units picked up a scent of some kind at Walnut

      Creek Recreational Area, but Lausten says

      authorities are still searching in other places,

      too. Nebraska State Patrol says in a news

      conference that the Emergency Missing

      Advisory regarding Ryan would expire as it’s

      been in place for 72 hours. Local, state, and

      federal agencies continue to assist with the

      search.




      Saturday May 22: LVPD tells 6 News that the recreational area 

      would remain closed another day as teams continued to look for

       Ryan. 6 News observes crews from Benington, Waterloo, and 

      Yutan coming in along Turkey Road to assist with the search. 

      The National Center for Missing and Exploited Children website

       displays a “missing” poster of Ryan. LVPD later reveals that 

      the Papio Natural Resources District began lowering 

      Walnut Creek Lake around 7 p.m.





      Sunday May 23: La Vista Police reveal that dive teams finished 

      preliminary searches in the area Saturday night, noting that 

      lowering the creek levels “will give search teams better physical

       and visual access” to the water. Police also passed along 

      resources from Project Harmony to help families talk about

       Ryan’s disappearance with children.




      Monday May 24: In a news conference, Chief Lausten says K9

       officers have given three indications. Noting that they could 

      have picked up an animal or human scent, or something else, 

      the chief says multiple dogs had hit in the same area — 

      “one Friday, one Saturday, and one (Monday)” — 

      so search efforts become focused on the northeast end of 

      Walnut Creek. Divers are able to access that area, 

      but Ryan isn’t found.




      Tuesday May 25: Authorities had no new information to share 

      Tuesday on the search, but said they believe Walnut Creek

       Recreational Area has been thoroughly searched.



      Wednesday May 26: La Vista Police says they are focusing search
       

      efforts on surveillance video, particularly one from La Vista

       Keno taking the day Ryan was last seen. LVPD asks 

      businesses and homeowners along Harrison Street, between 

      72nd and 96th streets, to check their security footage and 

      let police know if they see “any sign of Ryan.”








      What to do if you see Ryan

      Ryan, a sixth-grade student, was last seen Monday leaving school. 

      He is described as white, about 5 feet 8 inches tall, with brown

       hair and hazel eyes. At the time of his disappearance, 

      he was wearing a black jacket, blue jeans, an Old Navy 

      shirt, and was carrying a polka-dot umbrella.




      If you see Ryan, authorities say not to call his name; instead,

      keep your distance and call 911. Anyone with information about 

      his location should call Sarpy County Crimestoppers at 

      402-592-STOP (7867); or call 911. LVPD is also urging the 

      public to use its See It, Say It, Send It app to submit tips,

       but to also “be mindful of unsubstantiated rumors circulating

      on this case.”
