Returning to work

Follow your surgeon’s advice about how much time to take off work. For shock wave lithotripsy and percutaneous nephrolithotripsy, you’ll probably need at least a week off work. For open surgery, you can count on at least 3 weeks off work, and possibly more.

Medical Condition – Medical Release Opinion

One of the complications of getting your medical certificate is if you have a medical condition that may pose a risk to safety while operating a commercial motor vehicle.

How does this play into the FMCSA DOT physical exam?

The medical examiner has a responsibility to ensure that a commercial driver does not have any medical condition which could impact that driver’s ability to meet all the physical and mental demands of the job, now or for the period for which the medical card will be issued.

Here’s what the DOT doctor is checking for:

  • Have you had a medical condition which poses a risk to safety?
  • Do you have symptoms that may indicate an undiagnosed condition?
  • Do you currently have a diagnosed condition?
  • Is the condition being treated?
  • Is the treatment effective, and safe, for you to drive a CMV?
  • Is the medical condition stable, and safe, for you to drive a CMV?

If a medical condition is a concern, the medical examiner must evaluate whether the condition is a risk for incapacitation:

  • Is the onset of incapacitation symptoms so rapid as to interfere with safe driving?
  • Is the onset so gradual that you may be unaware of diminished capabilities?

Qualification For Your Medical Certificate

The DOT doctor, aka certified medical examiner, has been certified for evaluating the special circumstances of a commercial driver.

The Medical Opinion Release letter from your primary care physician helps the DOT doctor to evaluate your medical condition in view of the safety risk in driving a commercial vehicle. However, the decision to qualify or disqualify you for a medical certificate rests with the DOT doctor, not your primary care physician.

 Does the DOT physical exam include a drug test?

The DOT physical exam requirements do not include a drug test. You will still have to give a urine sample which is used for a kidney screen for potential medical conditions.

However, companies require a pre-employment drug test. So your company may request to have a drug screen done at the same time as you take your DOT physical. Not all medical examiner’s offices that conduct DOT physicals have a drug testing service.

Post operative RX

Activity

Your physical activity is to be restricted, especially during the first weeks of recovery. During this time use the following guidelines:

  1. NO lifting heavy objects (anything greater than 10 lbs) for 4 weeks.
  2. NO driving a car and limit long car rides for 2 weeks.
  3. NO strenuous exercise, limit stair climbing to minimum for 4 weeks.
  4. NO severe straining during bowel movements – take a laxative if necessary.
  5. DO drink plenty of fluids to keep your urine flow brisk. (This will flush out small clots as they continue to form as part of the healing process.)
  6. DO keep a urinal near. (You may have little warning before you need to empty your bladder. Some dribbling and poor control is normal for the first several weeks of healing.)

Specific Conditions That Can Make a Driver Medically Unfit

The federal Medical Examination Report asks a driver to self-identify 25 medical conditions, to answer eight specific medical questions, and to describe any other health conditions not specifically listed. The 25 conditions that are specifically listed include: (not listing them all)

Some of the other conditions included in the list of 25 that must be self-reported by truckers include:

  • Kidney problems. This includes—but is not limited to—kidney stones, painful urination, problems with urination.
  • Stomach, liver, or digestive problems.
  • Diabetes. This includes blood sugar problems. It should be noted if insulin is used.
  • Fainting or passing out.
  • Unexplained weight loss.
  • Missing or limited use of an arm, hand, finger, leg, foot, or toe.
  • Neck or back problems.
  • Bone, muscle, joint, or nerve problems.
  • Blood clots or bleeding problems.
  • Cancer.
  • Chronic infections or other chronic diseases.

All of these conditions should be discussed with a doctor. Some may not impact a particular driver’s ability to do his job safely. However, it may only take one of any of the conditions listed above to cause a driver to lose control of his truck and for a serious accident to result.

I was going to quote a reputable source saying specifically a driver cannot go back to work for a specific amount of time or based on a specific criteria for approval, but this is just common sense and common knowledge among those that "know". Truck drivers are jostled and sitting still for hours at a time, many have time requirements and will refuse to stop for bathroom breaks. They usually drink tons of coffee or energy drinks, pop advils(or other OTC) for headaches, sometimes they drink less water so they do not have to stop to pee. This particular truck driver is over weight, which is a risk factor for diabetes, kidney diseases, and he's "Top Heavy", which puts him at risk for heart disease, hypertension, stroke, blood clots (esp. post surgery).
My point being he would have needed to be cleared to go back to work, not only by his own Dr. but also by the DOT. Clearance by the DOT would take place after his 6 weeks post op follow up at the very soonest, if he was cleared to go back to work on the 14th of June by his personal physician, he would still have needed to be cleared by an independent examiner, with the DOT

Why would he say he was in MD on a haul on the day Summer went missing? Why not just say, he was recovering from kidney stone surgery, why claim you were out of town as a way to distance yourself from what your son might have been up to? You claim LE has cleared you for that day, did you tell them you were at Christie's down the road from the Wells' property, recovering from surgery? or did you tell them you were driving an 18 wheeler to MD, and therefore did not have eyes on your son. Come to find out, LE allegedly has not questioned your son. Come to find out another young man of 27 years old was also arrested on similar charges just days before your boy, on May 17, 2021, when his mother turned him in because she found disturbing photographs on his phone, of a 2 year old, which were taken May 8, 2021. This particular young man was a habitual offender, and habitually failed to report and violated terms of his parole.  Your boy, Mr Sherfey Jr. actually has charges going back to April 16th....this is just when he was caught, maybe the first time, maybe he has some juvenile records all sealed up? 
Also of note that Frank Edward Light was registered as a Sex Offender on June 16, 2021. I have not found an exact date for his release but he registered as a Sex offender on June 16th. As I understand, Registering entails going to the court house, it isn't automatic before you hit the streets. In Tennessee, the sex offender has 10 days to fill out a form to get their name on the registry. The 10 day time limit applies to: 10 days after being released from jail 
I am implying he Frank Light, very well, could have been out of jail, as early as the 6th of June.  Court records state that he was caught with 50 - 100 images on a thumb drive in 2016.
